I don't think it would be legal to include commercial assets from the BG1:EE game.
How would it be any more illegal than to include commercial assets from the original games?

Yes, the original 
BGT didn't really require the 
BG1 assets at all, cause they were packaged into the download archive, but the 
BGT-
weidu's 21 MBs couldn't, and it so didn't carry the 
BG1 assets like the original 
BGT's 500+MBs did ! So there', THE 
BGT-
WEIDU doesn't, while the Bardez 
BGT did. It was a gray zone, that no one poked about. Wanted that is. Which is part of the reason Ascension64's 
BGT-
weidu was quite revolutionary thing.
This is also a thing today, you don't really have commercial assets in the 
BG games, cause you know, the 
EE games were retroactiverly re-engineared from the original games, while licensesed by the non original Atari, from a studio bankruptcy. Yes, the world we live in, is a little bit complex.
